Welcome to The Revenge Store! The terms “we,” “us,” and “our” refer to The Revenge Store. The Revenge Store operates this store and website, including all related information, content, features, tools, products, and services in order to provide you, the customer, with a curated shopping experience (the “Services”). The Revenge Store is powered by Shopify, which enables us to provide the Services to you.

These terms and conditions, together with any policies referenced here (these “Terms of Service” or “Terms”), describe your rights and responsibilities when you use the Services.

Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy (therevengestore.com/policies/privacy-policy).  If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, and that you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase, or manage.

To use the Services, including accessing or browsing our online store or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address and billing, payment, and shipping information. You represent and warrant that all the information you provide is correct, current, and complete, and that you have all rights necessary to provide this information.

You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.

We have made every effort to provide an accurate representation of our products in our online store, and the photographs shown are of our actual products. Please note that colors and product appearance may differ slightly from how they appear on your screen due to the device you use and your display settings.

In addition, because our food items are made by hand and every box is hand-packed, small natural variations in color, packaging, and minor details are normal, and if an item is unavailable we may substitute one of equal or greater value. The care, curation, and contents of the box stay the same. We do not warrant that the appearance or quality of any product will meet your subjective expectations, but we stand behind the condition of what we ship — see our Refund Policy (therevengestore.com/policies/refund-policy) if something arrives damaged, incorrect, or incomplete.

All descriptions of products are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and to limit the quantities of any products we offer to any person, geographic region, or jurisdiction on a case-by-case basis.

Some of our boxes include food we make ourselves, such as Comeback Cookies and Pivot Popcorn. These items are made in a kitchen that handles common allergens, including  wheat, milk, eggs, soy, and they may contain or come into contact with these allergens. Full ingredient and allergen information is printed on each food package. If the recipient has a food allergy or sensitivity, please review the label on each item before eating, and do not order food items if there is a risk. You are responsible for sharing allergen information with the recipient of a gift box.

When you place an order, you are making an offer to purchase. The Revenge Store reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until we confirm acceptance, and we must receive and process your payment before your order is accepted.

Every box is made to order, hand-packed, and often personalized. Because production begins promptly, please review your order carefully before submitting — we may be unable to change or cancel an order once it has been accepted, including the shipping address.

Personalized add-ons (such as a custom tattoo phrase, a recorded sound-button message, or a greeting-card message) are produced from the exact text you submit. Please proofread before ordering — personalized items cannot be returned or refunded for typos or a change of mind. We may decline to produce personalization that is unlawful, hateful, threatening, or that infringes someone else’s rights.

Your purchases are subject to return, replacement, or refund solely in accordance with our Refund Policy (therevengestore.com/policies/refund-policy). You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

Prices, discounts, and promotions are subject to change without notice. The price charged will be the price in effect at the time the order is placed and set out in your order confirmation email. Unless otherwise stated, posted prices do not include taxes or, where applicable, shipping. We may offer promotions governed by separate terms; if there is a conflict, the promotion terms govern for that promotion.

You agree to provide current, complete, and accurate purchase, payment, and account information for all purchases, and to update it promptly so we can complete your transactions and contact you as needed. You represent and warrant that the payment information you provide is true and correct, that you are authorized to use the payment method, and that you will pay all charges incurred at the posted prices, including shipping and applicable taxes.

Shipping timing, costs, and delivery handling are described in our Shipping Policy (https://therevengestore.com/policies/shipping-policy). Delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers or events outside our control. Once we transfer products to the carrier, title and risk of loss pass to you — but if a box is lost in transit or arrives damaged, we will make it right as described in our Refund Policy.

Our Services, including all trademarks, brands, text, displays, images, graphics, video, and audio, and the design, selection, and arrangement thereof, are owned by The Revenge Store, its affiliates, or its licensors, and are protected by U.S. and foreign copyright, trademark, and other intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any material on the Services without our prior written consent. The Revenge Store’s names, logos, product and service names, designs, and slogans are trademarks of The Revenge Store and may not be used without our prior written permission. All other trademarks on the Services are the property of their respective owners. All rights not expressly granted are reserved.

When you submit personalization text, you represent that you have the right to use it, and you grant us permission to print, record, or otherwise reproduce it as needed to fulfill your order.

The Revenge Store is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with The Revenge Store. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and The Revenge Store, including any injury, damage, or loss resulting from purchased products and services. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with The Revenge Store.

All personal information we collect through the Services is subject to our Privacy Policy (therevengestore.com/policies/privacy-policy), and certain personal information may be subject to Shopify’s Privacy Policy. Because the Services are hosted by Shopify, Shopify collects and processes information about your access to and use of the Services in order to provide and improve them, and information you submit may be transmitted to and shared with Shopify and third parties to provide services to you. By using the Services, you acknowledge that you have read these privacy policies.

If you submit any ideas, suggestions, feedback, reviews, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display that Feedback in any medium for any purpose, including commercial use and promotion of the Services. You represent that you own or have all necessary rights to your Feedback, that you have disclosed any compensation or incentive received in connection with it, and that it complies with these Terms. We are under no obligation to keep Feedback confidential, to pay for it, or to respond to it.

You agree your Feedback will not violate any right of any third party (including copyright, trademark, or privacy), will not be unlawful, abusive, or obscene, and will not contain malware. You may not use a false identity or mislead us or others about the origin of any Feedback. You are solely responsible for any Feedback you submit. We may, but are not obligated to, monitor, edit, or remove Feedback we determine in our sole discretion to be objectionable or in violation of these Terms.

The Services may contain links to, or tools provided by, third parties that we neither monitor nor control. We provide access to such links and tools “as is” and “as available” without any warranty or endorsement, and we are not liable for your use of them or for any third-party websites, products, or services. Any use of optional third-party tools is at your own risk, and you should review the relevant third party’s terms and policies. New features we add in the future are also part of the Services and subject to these Terms.

Occasionally there may be information in the Services that contains typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times, or availability. We reserve the right to correct any such errors and to change or update information or cancel orders if any information is inaccurate at any time without prior notice, including after you have submitted your order.

You may access and use the Services for lawful purposes only. You may not use the Services: for any unlawful or malicious purpose; to violate any law or regulation; to infringe anyone’s intellectual property rights; to harass, abuse, defame, or harm any person; to transmit false or misleading information; to send spam or unsolicited promotional material; to impersonate any person or entity; or to interfere with anyone’s use of the Services.

You also agree not to: upload viruses or malicious code; reproduce, duplicate, copy, resell, or exploit any portion of the Services; collect or track others’ personal information; spam, phish, or pretext the Services; use any robot, spider, scraper, data-gathering or extraction tool, or automated means to access the Services; or bypass any security or access-control measure we use. We may suspend, disable, or terminate your access at any time, without notice, if we determine you have violated any part of these Terms.

The information presented through the Services is provided for general informational purposes only, and any reliance on it is at your own risk. Our products are gifts meant to bring comfort and a little humor; they are not medical, psychological, or therapeutic treatment, and nothing we sell is a substitute for professional care.

Except as expressly stated by The Revenge Store, the Services and all products offered through them are provided “as is” and “as available” without any representation, warranties, or conditions of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement. We do not guarantee that your use of the Services will be uninterrupted, timely, secure, or error-free. Some jurisdictions do not allow the disclaimer of implied warranties, so the above may not apply to you.

To the fullest extent provided by law, in no case shall The Revenge Store, or our partners, directors, officers, employees, affiliates, agents, contractors, service providers, or licensors (or those of Shopify and its affiliates), be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including lost profits, lost revenue, lost data, or replacement costs, whether based in contract, tort, strict liability, or otherwise, arising from your use of the Services or any product procured through them, even if advised of the possibility. Where liability cannot be excluded, our total liability for any order is limited to the amount you paid for that order. Some states do not allow certain limitations, so parts of this section may not apply to you.

You agree to indemnify, defend, and hold harmless The Revenge Store, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims, including reasonable attorneys’ fees, arising out of (1) your breach of these Terms or any documents they incorporate, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services.

Severability. If any provision of these Terms is found unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted and severed from the rest, and the remaining provisions will stay in effect.

Waiver; Entire Agreement. Our failure to enforce any right or provision is not a waiver of it. These Terms, together with any policies we post, are the entire agreement between you and us regarding the Services and supersede any prior agreements.

Assignment. You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign or transfer these Terms without notice to you.

Termination. We may terminate your access to the Services at any time at our discretion, and you remain liable for all amounts due up to termination. Sections that by their nature should survive termination (including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, and Indemnification) will continue to apply.

Governing Law. These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. You and The Revenge Store consent to the exclusive jurisdiction and venue of the state and federal courts located in Westchester County, NY.

We may update or replace any part of these Terms by posting changes to our website, and it is your responsibility to check periodically. We will notify you of material changes in accordance with applicable law. Your continued use of the Services after changes are posted constitutes acceptance of those changes.
